On June 17, 2019 the Israeli Competition Authority (“ICA“) published its Position Paper 1/19 (the “Position Paper“) with the aim to provide guidelines for institutional investors wishing to make joint decisions of companies that they hold.
Since according to the ICA cooperation between competing institutional investors may, under certain circumstances, amount to a restrictive arrangement under the Israeli Economic Competition Law, the Position Paper provides standards and guidelines in order to minimize concerns of violation of the Law.
